Brad Ostroff joined Frazer, Ryan, Goldberg & Arnold LLP in 2008 to continue his tax controversy practice. Brad had been a partner at Burch & Cracchiolo P.A. for 25 years before joining the firm.

He specializes in representing taxpayers involved in civil and criminal tax controversies with the Internal Revenue Service, as well as the state of Arizona. Prior to joining Burch & Cracchiolo, P.A. and now Frazer, Ryan, Goldberg & Arnold, L.L.P., Brad spent six years with the Internal Revenue Service, first a tax refund litigation attorney with the Office of Chief Counsel in Washington, D.C. from 1975 to 1978 and then as a Senior Trial Attorney with the Office of District Counsel in Phoenix, Arizona from 1979 to 1981.

Brad is an AV-rated attorney and is a Certified Tax Specialist by the State Bar of Arizona. He is listed in The Best Lawyers in America® under tax disputes and has been featured in Phoenix Magazine as one of the Best Lawyers in Phoenix, Arizona for civil and criminal tax disputes. Brad is a frequent speaker on civil and criminal tax topics for attorneys and certified public accountants.

Brad's civil and criminal tax representation includes:
  • Taxpayers under audit by the IRS, taxpayers before the IRS Appeals Office, and litigation in the United States Tax Court, United States District Court, Arizona Tax Court, and federal and state Courts of Appeal.
  • Taxpayers involved in collection matters with the Internal Revenue Service and Arizona Department of Revenue including negotiating installment payment agreements and offers in compromise.
  • Taxpayers involved in criminal tax investigations with the Internal Revenue Service and the state of Arizona including taxpayers who are targets of these investigations, as well as taxpayers who are witnesses.

Brad was a lead trial attorney in the small pension plan actuarial audit cases tried before the United States Tax Court in which the actuarial assumptions used in these pension plans were challenged by the Internal Revenue Service. He successfully represented a nationally known company in litigation with the Internal Revenue Service where the IRS unsuccessfully raised a captive insurance issue and contended that insurance purchased by this truck and trailer rental company from its insurance company subsidiary was non-deductible, self-insurance. Brad successfully litigated an issue before the United States Tax Court involving the valuation of partnership and assignee interests in a decedent's estate and recently represented attorneys before the United States Tax Court in which they indirectly maintained an ownership interest in the law firm through PLC's which in turn were owned by trusts. The IRS argued that the income flowing through the PLC's and trusts were the individual attorneys' income, over and above the salary that they received from the law firm, and that this income was subject to self-employment tax. Brad has successfully resolved the vast majority of his cases with the IRS without having to proceed to trial. A listing of these cases and issues would be exhaustive.

Brad has been married for 36 years to his wife Robin, a teacher, has two daughters, Megan, a high school teacher in Colorado, and Amanda, an actress in Florida. Brad enjoys skiing, hiking, traveling and hanging out with good friends.
