On October 28, 2022, Frazer Ryan partner Jimmy Cool, as co-counsel with the ACLU of Arizona, prevailed at the Arizona Court of Appeals in a case involving a public records request by the victim of a shooting in Marana, Arizona.
In April 2021, Jarron Smith was shot during an altercation in a Marana parking lot, in front of multiple witnesses. Marana police investigated and submitted the case to the Pima County Attorney’s Office, which decided not to file charges against either party after determining that the shooter’s actions were justified.
Later that month, Mr. Smith submitted a public records request to the Town of Marana. A week later, the Town provided a police report, redacted to exclude the names and images of both parties.
